Divorce

Uncontested Divorce
     If you and your partner have already negotiated all the terms of your divorce you may also agree to obtain an uncontested divorce.  Where the issues are very simple, and where you and your partner cooperate with one another, the New York court system offers the basic forms for you to file in order to get the uncontested divorce. 

     Many people feel comfortable filling in these forms, following the instructions on the website.  If you do it correctly, you can obtain an uncontested divorce without a lawyer.

     If you are not comfortable with the forms, or if you have some issues that are more complex and may require some degree of negotiation, or if your partner does not cooperate with you, you may need a lawyer to help get your divorce.  Jane can represent you in an uncontested divorce and she has a flat fee for this service.  Call for her current rates.

Contested Divorce
     If you have not already resolved all the issues with your partner by the time one of you files a divorce case in court, then your case will be listed by the court clerk as a contested divorce.  Most contested divorces end up being resolved with an agreement, sometimes without ever going to court and often after only one court appearance.  Others require much more work, sometimes even a trial.

     As an experienced litigator who has tried scores of cases in New York City involving issues such as grounds for divorce, child custody, child support, spousal support and equitable distribution, Jane will be your advocate in and out of the courtroom.  Jane charges an advanced retainer and bills at an hourly fee for contested matters.  Call for her current fee schedule.

Gay Divorce
     New York courts have recently signalled that a same-sex couple may file for divorce in our state provided that they were married in a place where gay marriage is legal.  This is a developing area of law.  It seems possible, however, that  married, gay couples will find themselves subject to the same rights and responsibilities as married, heterosexual couples and thus, subject to the same laws regarding child custody, alimony (maintenance) and equitable distribution. 

     Jane keeps up to date with recent developments in the law and is available to handle a same-sex divorce, whether as a mediator for both of you, or as the lawyer for one of you.
